1) Purpose of this Privacy Policy

HOLA RENT A CAR recognizes the importance of protecting the USER personal identifiable information (such as the USER name, telephone number, e-mail address and other contact information, collectively, "CONTACT INFORMATION") that the USER provide to HOLA RENT A CAR. This Privacy Policy sets forth our policies regarding the collection, use and disclosure of the USER CONTACT INFORMATION both through our online and offline operations. The purpose of this Privacy Policy is to tell the USER how HOLA RENT A CAR strives to better serve the USER by keeping the USER informed of promotions, products and services, while, at the same time, safeguarding the USER CONTACT INFORMATION. Our intent is to bring the USER offers and discounts that we believe are relevant to the USER interests offered by and through HOLA RENT A CAR and other non-affiliated companies with whom we have business relationships. 2) Protection Policy on personal information and commercial communications.

As established in Costa Rican laws, Grudos S.A. (hereon HOLA RENT A CAR) identified with legal ID# 3-101-091092, informs the USER about the existence of an electronic file, with personal information, created with the objective to give maintenance to the contractual relationship with the USER, as well as for relevant information to the USER on car rental related activities.

For electronic communications between the USER and HOLA RENT A CAR, the acceptance of the current Privacy Policy, supposes that the USER accepts the use of this media to send him/she advertising related to HOLA RENT A CAR commercial services. Every slot of information in the forms related to personal information needs to be completed with the correct information, unless it express otherwise, and the absence of these, will make impossible to process any USER enquiry, or any other service at the USER disposal within HOLA RENT A CAR web site.

In case the online reservation process fails, HOLA RENT A CAR will only retain those personal data given by the USER in order to receive communications from HOLA RENT A CAR by any media, including electronic mail or any equivalent media.

The only case in which this is not possible is when the USER cancels his consent for the use of this information, using the options displayed in the HOLA RENT A CAR web site. Nevertheless considering that HOLA RENT A CAR offers several services through his web site, the USER must read in detail the Terms and Conditions by which both parties agree to comply during the length of the contract that withhold the commercial relation, in order to be correctly informed at all times.

We will not be responsible or liable for any loss or damage arising from the USER failure to comply with this provision.

We will never request that the USER send us any sensitive contact information, such as the USER credit card number, password, membership number or pin number, in an e-mail or into a web site that is not located at the Hola.net domain name. If the USER receive an e-mail or other correspondence requesting that the USER provide any such information via e-mail or to a web site that is not on such domain name, please do not provide such information, it must be not answered, and report such request to our privacy officer at privacy@hola.net, so that HOLA RENT A CAR can pursue the proper legal measures.

4) ¿What other data does HOLA RENT A CAR capture from the USER?

HOLA RENT A CAR informs the USER that other than the CONTACT INFORMATION it captures the following; IP Address: IP address when the USER visits the web site. This information identifies the USER ISP (Internet Service Provider) and do not contains personal information of the USER. HOLA RENT A CAR uses this information to comprehend better where the web site traffic originates from.

Cookies: HOLA RENT A CAR uses "cookies" in his web site. "Cookies" are text encrypted files that the web site stores in the USER computer. When the USER voluntarily participates in any market research, published in the web site, he/she can be asked to give some personal information regarding his/her demographics, as age, sex, income range, family, etc... The USER can is free to give these or not. The results of the research are used solely to enhance the web site characteristics, as well to improve the services given by HOLA RENT A CAR in the web site.

Our web site may contain links or references to other web sites outside of our control, and the privacy policies of these sites may differ from our own. 7) Applicable Law and Jurisdiction

This Privacy Policy shall be governed by the laws of the Republic of Costa Rica as well as international agreements in intellectual rights, without regard to conflict of law principals. By providing any CONTACT INFORMATION to us, the USER fully understand and unambiguously consent to the transfer of such CONTACT INFORMATION to, and the collection and processing of such CONTACT INFORMATION in Costa Rica. The USER agrees that any cause of action that may arise under this Privacy Policy shall be commenced and be heard in the appropriate court in San Jose, Costa Rica.

8) Changes to this Privacy Policy

HOLA RENT A CAR reserves the right, at its discretion, to change, modify, add, or remove portions from this Privacy Policy at any time so visitors are encouraged to review this Privacy Policy at the beginning of each session.

9) Acceptance of this Privacy Policy

By using our Site, or otherwise providing the USER CONTACT INFORMATION to us, the USER signifies the USER acceptance of our Privacy Policy. If the USER does not agree to this policy, please do not use our Site or provide any CONTACT INFORMATION to us.

10) Privacy Policy Effective Date: December 2, 2008

If we materially change the way the USER personal information will be used, we notify the USER by way of either a prominent posting on our site, by mail and/or by email.
